Recovered More Than $2M in Demurrage Damages

We recovered damages our client suffered because of the prime contractor’s delay.

Our client signed a $44 million subcontract to manufacture and deliver structural steel components to replace a bridge in New Jersey. After fabricating the components, our client chartered a tug and barge to ship them to the project site. The prime contractor, however, was behind schedule and not ready to accept the steel components. As a result, when our client’s barge arrived, the components couldn’t be off-loaded and the barge to remain in port until the prime contractor was ready for the steel. This caused our client to incur more than $2.5 million in demurrage costs. We filed suit in federal district court to recover those additional costs. The parties settled the dispute early in the process, and our client recovered more than 90% of the amount claimed.
