Jackson Holcomb settled four separate cases consolidated before the Eastern District of Virginia, recovering a total of $1.65 million. All the cases arose from ship repair contracts with the US Navy. In each case, the client sought to recover the increased costs it incurred both to mitigate the spread of COVID-19 and to perform the ship repair during the pandemic.
Ship repair contracts were particularly susceptible to the spread of the virus, given the close working conditions existing within the vessels.
Each of the cases arose out of a fixed-price contract. One contract was awarded before the pandemic was declared. The remaining three were awarded after the declaration. All four were performed, at least in part, during the COVID-19 pandemic.
